General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) govern the rental of the Rigi Lakeside Apartments in Merlischachen by Amstutz Räben AG (hereinafter referred to as the “Operator”).

By making a booking, the guest accepts these GTC.

2. Conclusion of Contract

The accommodation contract is concluded upon completion of the online booking.

Bookings may be made directly through the website or through external booking platforms such as Booking.com, Airbnb, or other distribution partners.

For bookings made through third-party platforms, the respective booking and payment terms of those platforms shall also apply.

3. Prices and Payment Terms

All prices are quoted in Swiss Francs (CHF).

Published prices include all legally required taxes and tourist taxes unless expressly stated otherwise.

Payment terms are determined by the rate selected at the time of booking and/or the conditions of the respective booking platform.

The full booking amount must be paid no later than before check-in.

4. Cancellation and Amendments

Cancellation and amendment policies are governed by the rate selected at the time of booking and the conditions stated on the respective booking platform or booking confirmation.

The terms communicated at the time of booking shall prevail.

5. Check-in and Check-out

Check-in: from 4:00 PM

Check-out: by 10:00 AM

The apartments operate exclusively via self check-in.

Guests will receive the necessary access information before arrival.

Late check-out may be granted upon request and subject to availability. There is no entitlement to a late check-out.

6. Use of the Accommodation

The apartments may only be used for residential and holiday purposes.

The following are expressly prohibited:

• Parties or events

• Disturbance of neighbors

• Commercial use without the Operator’s consent

• Illegal activities

Visitors are permitted provided that neither the house rules nor the maximum occupancy limits are violated.

Guests must observe quiet hours in accordance with local regulations.

7. No Smoking and Pets

All apartments are non-smoking accommodations.

Smoking is prohibited inside the apartments, on balconies, and in all common areas.

Pets are not permitted.

In the event of a violation, the Operator may charge additional cleaning or damage-related costs.

8. Parking, EV Charging Station and Lake Access

Each apartment includes one parking space.

Available electric vehicle charging stations may be used in accordance with the on-site usage instructions.

Direct access to the lake is provided at the guest’s own risk.

The Operator accepts no liability for accidents, injuries, theft, or damage related to the use of the lake access, shoreline area, parking facilities, or charging stations.

9. Guest Liability

Guests are liable for any damage caused by themselves, their fellow travelers, or visitors to the building, furnishings, inventory, technical equipment, or outdoor facilities.

Any damage must be reported immediately.

The Operator is entitled to charge guests for damages incurred, extraordinary cleaning costs, or missing inventory items after departure, or to process such charges using the payment method provided during booking, where legally permitted.

10. Operator Liability

The Operator shall only be liable for damages caused intentionally or through gross negligence.

To the extent permitted by law, any further liability is excluded.

The Operator accepts no liability for the loss, theft, or damage of guests’ personal belongings.

Use of the accommodation, parking facilities, charging stations, and lake access is entirely at the guest’s own risk.

11. Internet Use

Guests are provided with complimentary Wi-Fi access.

Use of the internet for unlawful purposes is prohibited.

Guests are solely responsible for all activities conducted through their internet access.

Where there is reasonable suspicion of misuse, the Operator reserves the right to cooperate with authorities and provide any information required by law.

12. Data Protection

Personal data is processed in accordance with the current Privacy Policy published on staylakeside.ch.

To the extent necessary for the performance of the accommodation contract, personal data may be processed and shared with appointed service providers.

13. Force Majeure

If the accommodation cannot be provided, or can only be provided to a limited extent, due to events beyond the Operator’s control (including but not limited to natural disasters, governmental orders, power outages, pandemics, or comparable events), the Operator shall not be liable for any resulting damages.

Mandatory statutory rights remain reserved.

14. Exclusion of Guests

In the event of serious violations of these GTC, the house rules, legal provisions, or disturbances affecting other residents or neighbors, the Operator may terminate the stay with immediate effect.

In such cases, guests shall not be entitled to a refund of payments already made.

15. Final Provisions

Should any provision of these GTC be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

Swiss law shall apply exclusively.

The place of jurisdiction shall be Schwyz, Switzerland, unless mandatory statutory jurisdictions take precedence.
